Filing a takedown notice

If you believe content on IndieCrave infringes your copyright, send a written notice to dmca@indiecrave.com that includes:

1. A physical or electronic signature of the copyright owner or authorized agent.
2. Identification of the copyrighted work claimed to have been infringed.
3. The URL(s) of the infringing material on IndieCrave.
4. Your contact info: name, address, phone, email.
5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

What we do with it

On receiving a complete notice, we promptly remove or disable access to the material. We notify the artist who uploaded it and provide them a copy of your notice. Repeat infringers will have their accounts terminated.

Counter-notification

If you believe content was removed by mistake or misidentification, send a counter-notice to dmca@indiecrave.com that includes:

1. Your physical or electronic signature.
2. Identification of the material that was removed and where it appeared.
3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification.
4. Your contact info, including a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the US, any judicial district in which IndieCrave, LLC is found).

If we receive a valid counter-notice, we may restore the content unless the original complainant files an action seeking a court order against the artist within 10 business days.

Repeat infringers

It is our policy to terminate the accounts of users who are repeat infringers in appropriate circumstances.

False claims

Misrepresenting infringement (or lack thereof) under 17 U.S.C. § 512(f) may result in liability for damages.
